Joliet ¦ What the F@#K are you doing. My Rights.

Regular city inspections of rental properties could be expanded to single-family and owner-occupied homes under a proposal presented this week.

Inspection fees would double, triple and in some cases increase sevenfold under the proposal put before the city council’s land use committee on Tuesday.

Supporters of the plan say it is needed because growing numbers of single-family homes are being bought up and turned into rentals across the city as the real estate market stagnates.

The proposal was initiated by the Cathedral Area Preservation Association, a group known for its activism on neighborhood issues in the area of historic homes on the city’s near west side.

The new fee structure developed by city staff would increase the cost of an initial inspection on multifamily buildings from the current $60 to $175. The assortment of fees include an increase in the third re-inspection of a building from the current $80 to $300.  From The Herald <Spew> News

Being a property owner myself, I will just “Evict” my renters and make them homeless as will many other property owners around Joliet or I will add this on to the rent if these inspection fees are added.  Also  the city will be enforcing  a rule that requires landlords to open their tenants’ doors without permission and submit  to searches without the tennants knowlage…This makes it easier for the government to force its way into the homes of law-abiding citizens than it is to search the home of a suspected criminal.  The U.S. Constitution does not allow such an absurdity. The inspection of rental properties is only the first phase of the City’s plan to inspect all housing units.  If the City is not stopped, every resident  could face intrusive, unreasonable and expensive forced inspections of their homes as a condition of exercising their property rights.  Fortunately, the Supreme Court has repeatedly upheld the Fourth Amendment right to exclude the government from arbitrarily intruding into one’s home.  It is time for the state court in Illinois to do the same in this case.

To protect landlords, tenants and, ultimately, homeowners against searches that violate the Fourth Amendment, I suggest that Illinois ( Will County and Joliet) residents file a lawsuit under the U.S. and Illinois constitutions to stop the conducting or coercing consent to warrant-less inspections and also to ensure that constitutional standards govern residential inspections and rights are protected. I will call the ACLU when I get my first inspection notice.

I hate to tell you politicians that renters are voters and when your unwarranted inspections cost them a place to live or it costs renters to have to pay more in rent, their will be no question in my mind that they will vote your uneffective butts out of office and far as I am concerned these dumb asses should have been put out to pasture years ago.

    If these assholes think I am opening my home without a warrent they better think again, there is a thing called my rights and I will take Joliet and Will county to court…

    Maybe a few Million dollar law suits will change these politions minds and Like you said JJ they will get their butts voted out of office.

    Your rights as home owners will clearly be violated and your civic rights can as fall by the side if home owners are not careful.

    Civil Asset Forfeiture could come into play, this is the practice of law enforcement seizing and keeping money, property, and other assets which they suspect may have come from illegal profits – such as drug sales. Civil asset forfeiture often takes place without proof of the origins of the asset and without a conviction of anyone for wrongdoing. Law enforcement often retains the seized assets, or the proceeds from the sale of the assets, and uses the assets to fund further law enforcement efforts. As a result, a dangerous incentive is created for law enforcement to seize and keep assets at the expense of due process and individual liberties. As a landlord you could end up paying a high price for allowing a property you own to be used as a unkown drug house, as a tennant you could lose your freedom.

    Racial profiling – searching or targeting for investigation an individual on the basis of race, national origin or ethnicity.

    Think about this: even where evidence may have been illegally seized, there is no guarantee that the judge will suppress it as there are many exceptions to this rule as well. For example, if the police can show that they acted in good faith when they violated your rights, the judge may excuse their conduct and allow the evidence to stay in and be used against you.

    I will not allow anyone one to take my rights, I see what the Joliet Lawyer is saying and Joliet Jake thank you for bringing this to our attention, there is a true possibility that if we do not stop this now Will County and Joliet can and will most likely become a police state.

    Joliet is a maggot-infested corpse. The politicians have killed us with taxes and continue to consume us even though it’s killing us. Chalk it up to the huge salary of that B$tch Phyllis Wilson, superintendent of the Joliet school district. She does a lousy job and make $250,000. Our tax money.
